MARRIAGE REGISTRATION IN INDIA

Why Marriage Registration?
Hon’ble Supreme Court of India in Seema V Ashwani Kumar (2006 (2) SCC 578) has directed the state governments and Central Government to notify procedures for registration within three months from the date of judgment. Wherein direction were made to amend existing rules, or to frame new rules with direction to officers appointed under such rules of the state to register the marriage specifying the Age, Martial Status etc and all states counsels were directed to ensure directions given are followed immediately. Subsequently most of the states have made registration compulsory. Otherwise for travelling abroad, visa,
passport etc and to avoid any type of matrimonial relationship litigations its always advisable to register your marriage.

Where Marriage Registration?
As per residence of the parties are required to visit the Sub-Divisional Magistrate in whose Jurisdiction any of the parties i.e Husband or Wife resides during any working day from 9:30Am to 1:00PM. To find the SDM of your area contact us or visit Delhi government website.

Documents required and conditions for Marriage Registration?
  • Documentary Proof of Birth of Parties specifying their  marriageable age as per law are required . Any document out of Metric Certificate, passport or Birth Certificate serves the purpose.
  •  Ration Card or passport or address proof of the husband or wife is required showing their residence in the area of SDM Office approached for registration.
  •  In case of registration under Special Marriage Act residence proof of parties for more than 30 days required.
  •  Two passport size photographs of both the parties,
  • Marriage Photographs if available,
  • Marriage Invitation Card, 
  • Affidavit of both the parties in prescribed format with affirmation that parties not related to each other within prohibited degree of relationship as the case maybe,
  • Attested copy of Divorce Decree if applicable,
  • Conversion certificate if parties belong to another religion,
  • Nominal fee to be paid.
